These Terms of Service (“Terms”) apply to the monthly website and marketing services provided by GrowGrowLocal (“GGL,” “we,” “us,” or “our”). By approving a proposal, starting service, or paying an invoice, the client (“you” or “your”) agrees to these Terms and any plan details shown in the applicable proposal or order.
Services included
Website creation and design
GGL will create an initial website of up to six pages, including the home page. We will style the website to fit your business and handle its visual design. Logo design is not included and may be available for an additional fee.
Hosting, security, and website updates
GGL will host and secure the website while your service remains active and paid. The website’s main content will remain as approved unless you request changes. After launch, you may request website updates and new pages as part of the active service.
Blossom promotional content
The Blossom plan includes up to two promotional posts per week for social media, along with social media integration and posting, offer scheduling, engagement tracking, Google review visibility, and marketing-team help with offers.
Flourish promotional content
The Flourish plan includes up to 12 promotional posts per month and one short promotional video per week. It also includes TikTok integration and one monthly one-on-one marketing meeting, in addition to the website and marketing services listed in the plan.
Creation, revisions, and posting
A promotional post counts toward the plan allowance when it is downloaded or published. You may request up to two revisions before downloading or publishing it. GGL can create the included promotional posts without an additional creation fee. You may publish the finished material or ask GGL to post it on your behalf. Short videos are not included in Blossom and are limited to the weekly promotional video included with Flourish.
Pricing and billing
The monthly service fee is $99 for Blossom or $149 for Flourish, billed in advance. The first month is charged when service begins, and later payments are due on your monthly billing date.
The standard one-time onboarding fee is $250 and is charged when service begins. It is separate from the first monthly plan payment. Onboarding includes marketing-system setup, training, creation of the first month’s promotional offers, and a website design consultation.
After the minimum term, monthly service continues until canceled under Section 3. By beginning service, you authorize the recurring monthly charges described in your selected plan. Material changes to recurring fees or terms will be communicated before they take effect and handled as required by applicable law.
Minimum term and cancellation
The service has a four-month minimum term. After that term, service continues monthly until canceled.
To prevent the next monthly charge, give GGL cancellation notice at least 15 days before your next billing date. You may cancel by emailing hey@growgrowlocal.com or by using the online contact form. If notice arrives fewer than 15 days before the billing date, the next monthly payment will be charged and will be the final monthly payment, subject to the early buyout in Section 4.
GGL will confirm the effective cancellation date and final hosting date. Cancellation stops renewal charges after the final applicable billing period; it does not shorten an already paid month. For example, if the final monthly payment is made October 1, the website and hosting remain active through that paid period and end November 1.
Leaving before four months
If you cancel before completing the four-month minimum term and want the website files released, the early buyout is a flat $250. After the four-month minimum term is complete, there is no buyout fee.
The buyout pays for early release of the website files. It does not purchase additional hosting or extend the paid service period. You have until the end of your final paid month to move the website to GGL hosting-only service, currently $30 per month, or to another hosting provider.
Website export and departure
After you complete the minimum term—or pay the applicable early buyout—GGL will provide the website files, database, and assets included on the website. GGL does not charge a separate website export fee.
You are responsible for arranging hosting elsewhere and completing the move before GGL hosting ends. GGL hosting ends at the close of your final paid monthly period.
Domain names
You own a domain if you registered it directly or paid GGL to register it on your behalf. If a client-owned domain is held in a GGL account and GGL must transfer it to your account, a transfer-service fee may apply. GGL will disclose the fee and obtain your approval before performing a chargeable transfer.
Images and client materials
GGL may use images you supply, appropriately sourced images available without a license fee, and generated images in the website and promotional materials.
You are responsible for having the rights and permissions required for images, logos, text, and other materials you provide. GGL is responsible for following applicable usage terms for assets it sources. Including an asset in a website export does not expand third-party usage rights attached to that asset.
End of service
At the end of the final paid monthly period, GGL will stop hosting the website and providing the monthly services described above. Complete all website and domain transfers before that date to avoid an interruption to your online presence.
Governing law
These Terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-law principles.
